Wind noise and buffering in Hyundai Palisade

Here are the CA Lemon Laws:

Lemon Law Presumption. Within the Song-Beverly Act, there is a presumption guideline wherein it is presumed that a vehicle is a “lemon” if the following criteria are met within 18 months of delivery to the buyer or lessee or 18,000 miles on the vehicle’s odometer, whichever comes first, one or more of the following occurs:

1. The manufacturer or its agents have made two or more attempts to repair a warranty problem that results in a condition that is likely to cause death or serious bodily injury if the vehicle is driven.

OR

2. The manufacturer or its agents have made four or more attempts to repair the same warranty problem. If required by the warranty materials or by the owner’s manual, the consumer must directly notify the manufacturer about the problem(s), preferably in writing. The notice must be sent to the address shown in the warranty or owner’s manual.

OR

3. The vehicle has been out of service for more than 30 days (not necessarily consecutively) while being repaired for any number of warranty problems and the problems must be covered by the warranty, substantially reduce the vehicle’s use, value, or safety to the consumer and are not caused by abuse of the vehicle.

If these criteria are met, the Lemon Law presumes that the buyer or lessee is entitled to a replacement vehicle or a refund of the purchase price. However, this presumption is rebuttable. The manufacturer may show that the criteria has not been met (for example, because the problems are minor) and therefore, the buyer or lessee is not entitled to a replacement vehicle or refund.
Interesting..did Hyundai not already demonstrate that there is a significant problem when they issued the TSBs..and it seems they may have just decided to say ..the heck with it..if all of the above is true..owners may have a case...

The definition of a "significant problem" varies. From a marketing perspective, and because it should be an easy fix, they want to take care of it.

But from a legal perspective, it is definitely not a safety issue, and not a reliability issue ether. In fact, since virtually all of them have the same problem, it is not really a defect, but just a poor design that allows wind noise to be noticeable inside the vehicle.

A TSB is not a recall. It is just a Technical Service Bulletin to help dealer service personnel address certain issues or perform certain repairs that is not included in the shop manual.
 
What I was referring to with Ca was that the number of attempts differs between safety related and non safety related repair attempts, not that in CA it wouldn't be covered.

Yes, I understood that.

It's just not clear that wind noise is covered by the warranty if all (or virtually all) vehicles have the same noise, and the manufacturer chooses not to fix it.
 
Make the gap between interior door mold and window 15/32nd. Let's see how many other people start getting this new fix.

That's close to a 1/2". Sounds a bit ludicrous if you ask me. And with a Rubber Hammer? What are they doing exactly?

Is the foam placed in the channel considered a fix according to this. I mean it did effectively stop the wind noise on our palisade. Or does the fix require more than just a temporary or masking agent?

I just checked my Palisade that does not have the Wind Noise and I do have the foam in the corner of the door frame, under the window. It looks like this is the fix and I'm sure a new TSB will come out to do this to cars that are still having the issue.

My limited AWD has the foam also...the day I purchased the car I test drove ..no wind noise. I have noticed over the past couple of week the wind noise has increased and this morning had a whistle for the first time. Conclusion,does the foam wear away or move,or are there other areas that wear or shift with use. Sticking a piece of foam into the slot is not in my opinion a true fix.
 
Someone on a Facebook palisade group, said that her wind/whistle noise was fixed. Here is the posted solution.
Well I did comment last week how easy it was to move this area simply by squeezing with my hand..feels loose..at too much play..

Not sure about the durability of it, or potential shift in position.
 
Update? I'm curious how the fix worked.

So... even more of an update.. Now I seem to have a slight whistle while driving. Yesterday was pretty windy, but had a whistle while driving 35 mph. Then today, it's not windy and had it coming home going 60 mph. I just don't know what to do at this point.

I don't know if I have the foam, but mine has been in the shop 3 times now and just the other day I started having the hissing noise as well. Just awesome.

Turn the radio up ...that's the new TBS ..
 
I think they'd have a very tough time making that claim after issuing a TSB for it

The issuance of a Technical Service Bulletin does not require the manufacturer to notify owners or obligate them to even make the fix described in the TSB. We are not talking about a recall here.
